These Terms of Service govern your access to and use of the Dumb Shifts website, online store, content, forms, products, and related services. Throughout these Terms, “Dumb Shifts,” “we,” “us,” and “our” refer to the operator of the Dumb Shifts website and store.

By visiting our website, purchasing a product, submitting content, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the website or services.

1. Eligibility

You must be at least the age of majority in your state, province, or country to make a purchase or submit content. If you are under the age of majority, you may use the website only with the involvement and permission of a parent or legal guardian.

You are responsible for ensuring that your use of the website complies with all laws that apply to you.

2. Shopify

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you. Shopify is not the seller of Dumb Shifts merchandise and is not responsible for our products, content, fulfillment, or customer service.

Your use of certain Shopify features may also be subject to Shopify’s own terms and privacy practices.

3. Accounts and Information

You agree to provide current, complete, and accurate information when placing an order, submitting a form, or creating an account.

You are responsible for protecting your account credentials and for activity conducted through your account. Contact us promptly if you believe your account or payment information has been used without authorization.

We may suspend or terminate accounts containing false information or associated with fraudulent, abusive, or unlawful activity.

4. Products and Availability

Products, sizes, colors, designs, prices, and availability may change without notice.

We make reasonable efforts to display products accurately. However, colors and details may appear differently depending on your screen, device, lighting, manufacturing process, or print placement. Minor variations do not necessarily constitute a defect.

All products are subject to availability. We may limit quantities, discontinue products, restrict sales by person or location, or refuse an order when reasonably necessary.

5. Orders

Submitting an order does not guarantee acceptance. An order-confirmation email confirms that we received your order, not that we have accepted or shipped it.

We reserve the right, to the extent permitted by law, to refuse, limit, or cancel an order for reasons including:

Product unavailability
Suspected fraud or unauthorized payment
Incorrect pricing or product information
Resale activity
Violation of these Terms
Shipping restrictions
Technical or inventory errors

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

We may limit or prohibit orders that appear to be placed by dealers, resellers, or distributors without prior written authorization.

6. Pricing and Payment

Prices are shown in the currency displayed at checkout and may change without notice. Taxes, shipping charges, duties, and other applicable fees may be added at checkout.

You authorize us and our payment providers to charge the payment method submitted for your order.

We may correct pricing, product-description, discount, or calculation errors at any time. If an error affects an order already placed, we may contact you for approval of the corrected amount or cancel and refund the affected order.

Discounts cannot be combined unless expressly stated. Promotional offers may be changed or withdrawn at any time before an order is completed.

7. Shipping and Delivery

Delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, labor disruptions, supply shortages, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs resulting from an incorrect address, refused package, or unclaimed shipment may be charged to the customer.

To the extent permitted by law, responsibility for a shipment passes to the customer when the carrier records delivery to the address provided at checkout.

International customers are responsible for applicable customs duties, taxes, import fees, and compliance with local import requirements.

8. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.

Personalized, customized, made-to-order, clearance, and final-sale products are not returnable or refundable except when required by law or when the product arrives defective or materially different from what was ordered.

Products returned without approval or outside the stated return period may be refused.

9. Personalized and Custom Products

Customers are responsible for reviewing personalization details, spelling, sizing, colors, and other selections before submitting an order.

We are not responsible for errors entered or approved by the customer. Personalized or custom orders cannot be changed or canceled after production begins.

We may refuse personalization requests containing unlawful, infringing, threatening, hateful, obscene, or otherwise inappropriate material.

10. Dumb Shifts Content and Intellectual Property

Unless otherwise stated, the website and its contents—including the Dumb Shifts name, logos, artwork, graphics, product designs, photographs, videos, podcast materials, audio, text, slogans, and website layout—are owned by or licensed to Dumb Shifts.

You may access this content for personal, noncommercial use only. You may not copy, reproduce, modify, distribute, sell, license, publish, scrape, or create derivative works from our content without written permission.

Nothing in these Terms grants you ownership of or a license to use Dumb Shifts trademarks, branding, product designs, or other intellectual property for commercial purposes.

Third-party names, vehicles, logos, and trademarks belong to their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation unless expressly stated.

11. Car and Community Submissions

When you submit vehicle photographs, videos, stories, specifications, modifications, comments, or other materials, you represent that:

You own the submitted material or have permission to submit it
The material does not infringe another person’s copyright, trademark, privacy, publicity, or other rights
Everyone identifiable in the material has provided any permission required for its submission and authorized use
The submission is accurate to the best of your knowledge
The submission does not contain unlawful, harmful, confidential, or misleading material

You retain ownership of original material you submit.

You grant Dumb Shifts the permissions described in the applicable submission form, including permission to reproduce, crop, resize, format, edit for clarity, publish, display, and repost the material through authorized Dumb Shifts channels. This includes reasonable promotion of the resulting community feature.

Unless separately agreed in writing, submissions are voluntary and do not entitle you to payment, royalties, merchandise, advertising revenue, or any other compensation.

Submitting a vehicle does not guarantee that it will be reviewed, published, discussed, or featured. We may accept, reject, edit, remove, or stop using a submission at our discretion, subject to applicable law and any written agreement.

Permission to use a submission in paid advertising, product designs, or merchandise may require a separate written agreement when that use is not covered by the original submission permission.

12. Reviews, Messages, and Other User Content

If you submit a review, comment, testimonial, message, or other content, you grant us a nonexclusive, worldwide, royalty-free license to reproduce, publish, display, format, and share that content in connection with our business.

We may moderate, reject, or remove content that we reasonably believe is unlawful, fraudulent, misleading, abusive, offensive, infringing, spam, or unrelated to our services.

You may not impersonate another person, submit false reviews, or use a false email address or identity.

13. Automotive and Entertainment Disclaimer

Dumb Shifts content is provided for entertainment and general informational purposes only.

Our podcasts, videos, articles, social posts, and other content do not constitute professional mechanical, engineering, safety, legal, financial, or driving advice.

Vehicle modification, repair work, track driving, racing, and motorsports can involve serious risk, including property damage, injury, or death. You are solely responsible for evaluating those risks, using qualified professionals, following manufacturer instructions, wearing appropriate safety equipment, and complying with applicable laws and track rules.

Do not rely solely on Dumb Shifts content when making safety-sensitive decisions.

14. Prohibited Uses

You may not use the website or services to:

Violate any law or regulation
Infringe intellectual-property, privacy, or publicity rights
Submit false, fraudulent, or misleading information
Distribute malware or harmful code
Attempt unauthorized access to the website or another user’s information
Scrape, harvest, crawl, or collect data without permission
Interfere with website security or operation
Commit payment fraud or abuse promotions
Harass, threaten, defame, or discriminate against another person
Resell products commercially without authorization
Use Dumb Shifts branding to suggest an unauthorized affiliation

We may restrict or terminate access for suspected violations.

The website may contain links, embeds, or integrations involving YouTube, social-media platforms, payment processors, carriers, and other third parties.

We do not control and are not responsible for third-party websites, products, services, availability, security, content, policies, or practices. Your use of a third-party service is subject to that provider’s terms.

A third-party link does not necessarily constitute an endorsement.

16. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the website, placing an order, or submitting a form, you acknowledge that information may be processed by Shopify, payment providers, shipping providers, and other service providers necessary to operate the store.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, and services are provided “as is” and “as available.”

We do not guarantee that the website will always be available, uninterrupted, secure, accurate, or error-free. We do not guarantee that every defect or technical issue will be corrected.

Except for warranties that cannot legally be excluded, we disclaim all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

18. Limitation of Liability

To the fullest extent permitted by law, Dumb Shifts and its owners, employees, contractors, representatives, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost opportunities, or reputational harm.

To the fullest extent permitted by law, our total liability arising from a product, order, submission, website use, or these Terms will not exceed the amount you paid to Dumb Shifts for the specific product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded.

19. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Dumb Shifts and its owners, employees, contractors, representatives, affiliates, and service providers from claims, losses, damages, liabilities, and reasonable costs arising from:

Your violation of these Terms
Your unlawful or improper use of the website
Content or materials you submit
Your violation of another person’s intellectual-property, privacy, publicity, or other rights
Fraudulent or unauthorized activity associated with your account or order

This obligation does not apply to the extent a claim was caused by our own unlawful conduct.

20. Suspension and Termination

We may suspend or terminate access to the website or services when we reasonably believe a user has violated these Terms, engaged in fraud, threatened the security of the store, or created legal or operational risk.

Terms that by their nature should survive termination—including intellectual-property provisions, disclaimers, liability limitations, indemnification obligations, and dispute provisions—will remain in effect.

21. Governing Law and Disputes

These Terms are governed by the laws applicable in the jurisdiction where Dumb Shifts maintains its principal place of business, without regard to conflict-of-law rules.

Before filing a legal claim, you agree to contact us at dumbshifts.business@gmail.com and attempt to resolve the dispute informally. Nothing in this section prevents either party from seeking emergency or injunctive relief when appropriate.

Any legal proceeding must be brought in a court with proper jurisdiction, subject to any consumer rights regarding venue that cannot be waived.

22. Changes to These Terms

We may update these Terms to reflect changes to our business, services, practices, or legal obligations.

The updated version becomes effective when posted unless otherwise stated. The “Last updated” date will identify the most recent revision. Continued use of the website after an update constitutes acceptance to the extent permitted by law.

23. Severability and No Waiver

If any provision is found unlawful or unenforceable, that provision will be enforced to the maximum permissible extent, and the remaining provisions will remain effective.

Our failure to enforce a provision does not waive our right to enforce it later.

24. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional terms presented during a transaction or submission, constitute the agreement between you and Dumb Shifts concerning the website and services.

If specific terms presented for a product, promotion, or submission conflict with these general Terms, the more specific terms control for that transaction or submission.
